That article isn’t exactly correct. Members of the House of Representatives are elected by the state they represent so, unless challenged at the state level, their elections are not easily derailed. Since they are sworn in by the Dean (the longest serving member of the body) all it takes if for one incumbent to be re-elected and the entire body can be sworn in.
As for their effect on the Presidency, unless one party sweeps the super-majority in both houses of Congress, I doubt they’d be able to pass any law changing the path to the Presidency. Therefore, if the presidential portion is undecided, the Speaker of the House would take over until the new President is declared.
One possible issue would be if the newly sworn-in House couldn’t elect a new Speaker in time. But since the Speaker is effectively chosen by the majority party, it is very unlikely that would happen while the presidential election is undecided.
Furthermore, many states are capable of handling mail-in voting and have been doing it for years so while some places may have issues, others won’t. Add to that the fact that there will still be a lot of in-person voting and I don’t see congressional elections having too many issues.
I enjoyed the article as it was more thought provoking than completely right.
If litigation should ensue at many levels (local, state & federal) then it seems plausible to me that there could be many elections undecided for a long period of time.
Whether that could cause the House to be unable to elect a new speaker I have no idea.
It seems highly implausible but after Trumps win in 2016 I wouldnt say impossible to most things to do with elections any more
I agree that there are lots o states that can and will have few, if any, issues with large mail in ballot volumes. Some will be overwhelmed as they are not and have not prepared for it very well.
Lets just say that it will be interesting right up to the moment a new president elect is done taking his oath
As I’ve mentioned before my wife works part time for the Registar of Voter here in San Diego. They were told that in elections previous to this one California routinely processed 75% of ballots as mail-in… so they have the procedures to up the count to 100% if necessary. And State law requires that all election processes (counts, validation etc) be complete no later than 30 after the election (ie. Dec 4th 2020)
