No you dont need a license any more to use/create MP3’s
You may not need a license anymore, but Apple still doesn’t support it.
OP would need to use another library, which they seem to be asking not to do. 
dunno but apple makes many mentions of MP3 as a format -however I cant spend all day looking at whether they support exporting it from AVFoundation or not
